Can a partnership set up an education assistance plan?

Businesses may set up employer-paid education assistance plans to cover higher education costs that are tax free up to $5,250 a year (or for any amount if the courses are job related). However, educational assistance plans may not be advisable for closely owned businesses since no more than 5% of benefits may be for the benefit of owner-employees and their spouses or dependents. Partners are not treated as employees for this purpose and cannot receive benefits under education assistance plans.
