Whether a worker is an employee or an independent contractor depends on the situation. If the company has the right to say when, where, and how the work gets done, the person is probably an employee.
It is theoretically possible for a person to have dual work status for the same company (be an employee and also provide services as an independent contractor). However, the facts would be highly unusual.
