I owed a tax penalty for 2006 that I paid in 2008. Can I include this as part of my itemized tax deduction?

Tax penalties and interest are not deductible. If you paid back state income taxes, then they can be added to your deductible state and local income taxes. If you paid back federal income taxes, they are not deductible.
